Introductory provisions<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">These terms and conditions (hereinafter referred to as &quot;\u201e<\/span><strong><span style=\"font-family: Times New Roman, serif;\">terms and conditions<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">\u201c&quot;) regulate mutual rights and<\/span><span style=\"font-family: Times New Roman, serif;\">\u00a0<\/span><span style=\"font-family: Times New Roman, serif;\">responsibilities between:<br \/><\/span><strong><span style=\"font-family: Times New Roman, serif;\">Atelier Kupka sro.<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">, with its registered office at Hv\u011bzdov\u00e1 13, 602 00 Brno, Company ID: 26232936, registered in<\/span><span style=\"font-family: Times New Roman, serif;\">\u00a0<\/span><span style=\"font-family: Times New Roman, serif;\">in the commercial register kept by the Regional Court in<\/span><span style=\"font-family: Times New Roman, serif;\">\u00a0<\/span><span style=\"font-family: Times New Roman, serif;\">Brno, Section C, File 38619 (hereinafter referred to as &quot;\u201e<\/span><strong><span style=\"font-family: Times New Roman, serif;\">seller<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">\u201c&quot;) and<\/span><span style=\"font-family: Times New Roman, serif;\">\u00a0<\/span><span style=\"font-family: Times New Roman, serif;\">by persons who, through the online store at <\/span><strong><span style=\"font-family: Times New Roman, serif;\">www.motorjournal.cz\/shop\/<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"> conclude a purchase contract with the seller (hereinafter referred to as the &quot;\u201e<\/span><strong><span style=\"font-family: Times New Roman, serif;\">buyer<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">\u201c).<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">These terms and conditions govern the relationship between the seller and:<\/span><\/p>\n<ul>\n<li><strong><span style=\"font-family: Times New Roman, serif;\">consumer<\/span><span style=\"font-family: Times New Roman, serif;\">\u2013 a natural person who, when concluding and performing a contract, does not act in<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\">within the scope of their business activities or profession (hereinafter referred to as <\/span><\/span><\/span><strong><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\">\u201e<strong><span style=\"font-family: Times New Roman, serif;\">consumer<\/span><span style=\"font-family: Times New Roman, serif;\">\u201c),<\/span><\/strong><\/span><\/span><\/span><\/strong><\/li>\n<li><strong><span style=\"font-family: Times New Roman, serif;\">businessman<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"> \u2013 a legal entity or a natural person doing business, acting in<\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\">within the scope of its business activities (hereinafter referred to as <\/span><\/span><\/span><strong><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-family: Times New Roman, serif;\">\u201e<strong><span style=\"font-family: Times New Roman, serif;\">businessman<\/span><span style=\"font-family: Times New Roman, serif;\">\u201c).<\/span><\/strong><\/span><\/span><\/span><\/strong><\/li>\n<\/ul>\n<p><span style=\"font-family: Times New Roman, serif;\">The provisions of these terms and conditions that apply exclusively to consumers are <\/span><strong><span style=\"font-family: Times New Roman, serif;\">they will not use<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"> for<\/span><span style=\"font-family: Times New Roman, serif;\">\u00a0<\/span><span style=\"font-family: Times New Roman, serif;\">Entrepreneurs. The special provisions set out in Article 11 of these Terms and Conditions apply to entrepreneurs.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">These terms and conditions apply exclusively to <\/span><strong><span style=\"font-family: Times New Roman, serif;\">purchase of goods<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"> via e-shop. <\/span><a href=\"https:\/\/www.motorjournal.cz\/en\/predplatne\/obchodni-podminky-pro-predplatne\/\" target=\"_blank\" rel=\"noopener\"><strong><span style=\"font-family: Times New Roman, serif;\">On<\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">\u00a0<\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">magazine subscription<\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">at Motor Journal<\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\"> or other services are subject to separate <\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">terms and conditions<\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">.<\/span><\/strong><\/a><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">These terms and conditions are an integral part of the purchase contract. Deviating provisions in the purchase contract take precedence over the wording of these terms and conditions.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">2. Information about goods and prices<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">Information about the goods, including descriptions and prices, is provided on the e-shop website.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">All prices are in CZK and include VAT unless otherwise stated.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The offer of goods on the website is for informational purposes only; the seller is not obliged to conclude a purchase contract according to the displayed offer if there is a reason preventing performance (e.g. technical error, out of stock).<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\"><b>3. Order and conclusion of the purchase contract<\/b><\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The buyer creates and sends an order via the e-shop&#039;s web interface. Before sending the order, the buyer has the opportunity to check and correct the data.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The purchase contract is formed by sending the order by the buyer and subsequent confirmation of the order by the seller by e-mail sent to the buyer&#039;s address.<\/span><\/p>\n<p><strong><span style=\"font-family: Times New Roman, serif;\">The seller reserves the right to withdraw from the purchase contract at any time.<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">, and even&nbsp;<\/span><strong><span style=\"font-family: Times New Roman, serif;\">after sending the order confirmation by email<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">, especially if:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: Times New Roman, serif;\">the goods are not available or are displayed incorrectly on the website,<\/span><\/li>\n<li><span style=\"font-family: Times New Roman, serif;\">there was an obvious error in the stated price or description of the goods,<\/span><\/li>\n<li><span style=\"font-family: Times New Roman, serif;\">or there is another objective reason that makes delivery impossible.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: Times New Roman, serif;\">In the event of the seller&#039;s withdrawal from the contract, any amount already paid will be refunded to the buyer. <\/span><strong><span style=\"font-family: Times New Roman, serif;\">without undue delay<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"> in the same manner in which the payment was received, unless otherwise agreed.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">4. Payment terms<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The buyer can choose one of the following payment methods when placing an order:<\/span><\/p>\n<p><strong><span style=\"font-family: Times New Roman, serif;\">Via the GoPay payment gateway:<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"font-family: Times New Roman, serif;\">by payment card (MasterCard, Maestro, VISA, VISA Electron, V Pay),<\/span><\/li>\n<li><span style=\"font-family: Times New Roman, serif;\">by accelerated bank transfer,<\/span><\/li>\n<li><span style=\"font-family: Times New Roman, serif;\">QR code.<\/span><\/li>\n<\/ul>\n<p><strong><span style=\"font-family: Times New Roman, serif;\">Other methods (without payment gateway):<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"font-family: Times New Roman, serif;\">by bank transfer,<\/span><\/li>\n<li><span style=\"font-family: Times New Roman, serif;\">QR code,<\/span><\/li>\n<li><span style=\"font-family: Times New Roman, serif;\">C.O.D,<\/span><\/li>\n<li><span style=\"font-family: Times New Roman, serif;\">in cash upon personal collection at the seller&#039;s headquarters.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: Times New Roman, serif;\">The seller issues a tax document.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">Payment via the GoPay payment gateway is considered to have been made at the moment the amount is credited to the seller&#039;s account.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">All payments via the GoPay payment gateway are <\/span><strong><span style=\"font-family: Times New Roman, serif;\">secured by encryption and standard security procedures<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">, to protect the buyer&#039;s data.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The buyer has the right at any time to obtain information about his payment and access to the data that the seller processes for the purposes of its processing.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">Unless otherwise agreed, the purchase price is payable according to the chosen payment method; for transfers, the usual payment period is 5 business days from the conclusion of the contract.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">5. Delivery of goods<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The buyer chooses the delivery method when ordering.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">Personal collection is possible at the address: Hv\u011bzdov\u00e1 13, 602 00 Brno, <\/span><strong><span style=\"font-family: Times New Roman, serif;\">after prior arrangement with<\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">\u00a0<\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">to the seller<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">Delivery costs are displayed before the order is sent.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The risk of damage to the goods passes to the buyer upon receipt.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">6. Withdrawal from the contract (consumer)<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The consumer has the right to withdraw from a distance contract within 14 days of receipt of the goods without giving any reason.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">To exercise the right of withdrawal, the consumer can use <a href=\"https:\/\/www.motorjournal.cz\/en\/odstoupeni-od-smlouvy\/\">electronic form<\/a> available on the website.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The consumer is obliged to return the goods <\/span><strong><span style=\"font-family: Times New Roman, serif;\">without undue delay, no later than 14 days from the date of withdrawal, <\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">and that<\/span><\/strong> <span style=\"font-family: Times New Roman, serif;\">v <\/span><strong><span style=\"font-family: Times New Roman, serif;\">original condition<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"><b>, without signs of use, damage or deterioration, in <\/b><\/span><strong><span style=\"font-family: Times New Roman, serif;\"><b>all ori<\/b><\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">in original packaging and with complete accessories<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\"><b>, if it was included in the delivery,<\/b><\/span><span style=\"font-family: Times New Roman, serif;\"> to the seller&#039;s address.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The costs of returning the goods are borne by the consumer.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The seller will return the paid funds to the consumer no later than 14 days after receiving the returned goods. <\/span><strong><span style=\"font-family: Times New Roman, serif;\">by transfer to the bank account specified by the consumer in the withdrawal form<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The consumer cannot withdraw from the contract in cases defined by law (e.g. custom-made goods, perishable goods, delivery of sealed goods that the consumer has unpacked after delivery and cannot be returned for hygiene reasons, etc.).<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">7. Rights arising from defective performance (complaints)<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The rights and obligations of the parties arising from defective performance are governed by the relevant provisions of the Civil Code and the Consumer Protection Act.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The warranty period is 24 months from receipt of the goods, unless otherwise stated for a specific product.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The buyer shall report the defect without undue delay after discovering it, at the latest., <\/span><strong><span style=\"font-family: Times New Roman, serif;\">through <\/span><\/strong><a href=\"https:\/\/www.motorjournal.cz\/en\/reklamace\/\"><strong><span style=\"font-family: Times New Roman, serif;\">electronic form<\/span><\/strong><\/a><strong><span style=\"font-family: Times New Roman, serif;\"> on the website. <\/span><\/strong><strong><span style=\"font-family: Times New Roman, serif;\">The consumer is obliged to file a complaint no later than 2 months after discovering an obvious defect and within 2 years after receiving the goods in the case of a hidden defect.<\/span><\/strong><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The seller will handle the complaint without undue delay; unless otherwise agreed, no later than 30 days from the date of the complaint. The buyer will be informed of the result by e-mail.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">A legitimate complaint will be resolved in the form of <\/span><strong><span style=\"font-family: Times New Roman, serif;\">exchange of goods<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">, if possible; for the consumer, it is also possible to refund the purchase price to the account specified in the form. The entrepreneur is entitled to a refund of the purchase price only in the event of an agreement with the seller.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">8. Protection of personal data<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The seller processes the personal data of buyers in accordance with the GDPR (EU Regulation 2016\/679) and Act No. 110\/2019 Coll.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">More detailed information about the processing of personal data is provided in the privacy policy, which is part of the e-shop website.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">9. Electronic communication<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The buyer agrees to communication by electronic means (e-mail). The seller confirms receipt of the order and informs about the status of the order via e-mail.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The contracting parties agree to use e-mail to deliver information related to the performance of the contract, unless otherwise provided by law.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">10. Out-of-court settlement of consumer disputes<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The consumer has the right to seek out-of-court settlement of consumer disputes, with the competent authority in the Czech Republic being the Czech Trade Inspection Authority (\u010cOI).<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The consumer can also use the European Online Dispute Resolution Platform: https:\/\/ec.europa.eu\/consumers\/odr<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">11. Special provisions for entrepreneurs<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The provisions of this article apply to buyers who act as entrepreneurs when concluding a contract.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">Entrepreneurs are not subject to the reliefs and protections provided to consumers (e.g. the right to withdraw within 14 days).<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The risk of damage to the goods passes to the entrepreneur upon receipt of the goods.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">Rights arising from defective performance against the entrepreneur are governed by the relevant provisions of the Civil Code; the guarantee is provided only to the extent agreed between the parties.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The seller is not liable to the entrepreneur for lost profits, loss of orders or other indirect damages.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">All disputes between the seller and the entrepreneur will be resolved by the court with substantive and territorial jurisdiction at the seller&#039;s registered office, unless the parties agree otherwise.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">12. Final provisions<\/span><\/h2>\n<p><span style=\"font-family: Times New Roman, serif;\">The Seller reserves the right to change the terms and conditions; changes shall become effective upon publication on the website. Changes shall not have retroactive effect on contracts already duly concluded, unless otherwise agreed between the parties.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">If any provision of these Terms and Conditions is invalid or ineffective, this shall not affect the validity of the remaining provisions.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">The contract and terms and conditions are drawn up in the Czech language; in the event of translation into another language, the Czech text shall prevail.<\/span><\/p>\n<p><span style=\"font-family: Times New Roman, serif;\">T<\/span><span style=\"font-family: Times New Roman, serif;\">These terms and conditions are valid and effective from the date: <\/span><strong><span style=\"font-family: Times New Roman, serif;\">5. 11. 2025<\/span><\/strong><span style=\"font-family: Times New Roman, serif;\">.<\/span><\/p>\n<h2 class=\"western\"><span style=\"font-family: Times New Roman, serif;\">13.
